Terms of Use

Acceptance of the Terms of Use

  1. By using, accessing, reaching or otherwise obtaining the services or products (“Service,” “Services,” “Products”) that are provided by GSRV (“we,” “us,” “our,” “Company”) or the website located at gsrvhosting.com (“Site,” “Website,” “Platform”), you (“Client,” “User”) agree that you are authorised to accept the GSRV Terms of Use (hereinafter referred to as “Terms of Use,” “Terms and Conditions,” “Terms,” “Conditions”) on behalf of yourself, the company that you represent, or both, where the latter is applicable. All Services are subject to the Terms that GSRV has listed in this contract. By utilising the Services, you agree to be bound by the Terms. If you do not accept the Terms, do not use the Services.
  2. If any provision of these Terms and Conditions or any agreement appears to have been destroyed or is legally invalid, this shall not affect the validity of the Terms and Conditions/agreement. The parties shall replace the provision(s) which, in so far as permitted by law, correspond(s) to the intent of the original provision/agreement.
  3. Exemptions to these Terms must be agreed to in writing by GSRV and shall only apply with respect to the specific agreement to which the exception relates. In case the Conditions and the agreement contain conflicting provisions, the provisions contained in the agreement shall take precedence unless explicitly stated otherwise in the contract.
  4. To accept the Terms, you must be of the minimum age of digital consent in your country. If you are below the age of majority in your jurisdiction or if your age is below 18, you may not use the services unless your legal guardian has reviewed and agrees to the Terms.
  5. GSRV reserves the full right to modify the Terms at any time with or without informing you before we issue the changes. The new Terms (“Amended Terms”) take action immediately after published. Your continued use of the Services constitutes your acceptance of and agreement to the Amended Terms. If you do not accept or if you object to the Amended Terms, you shall cease using the Services.
  6. We reserve the right to modify or discontinue, temporarily or permanently, the Services with or without notice.

General Terms and Conditions

  1. You shall not use the Services if you do not agree to the Terms. Use of the Services demonstrates and constitutes the acceptance of these Terms.

  2. You must follow all policies made available to you within the Services.

  3. Use the Services only as permitted by law and the applicable regulations. The misuse of our Services is precluded and constitutes a breach of this contract.

  4. You might not interfere with, disrupt or otherwise deny our Services, files and other software that may come with our Services or endeavour to access these utilising a method other than the interface and the instructions that we provide.

  5. GSRV reserves full rights to terminate any contract between you and us or suspend your account, related service(s), or both. We might stop providing our Services to you if you do not comply with our Terms and policies or if we are investigating malicious activities, including those based entirely on suspicion.

  6. Distributing, promoting, producing and developing harmful software, viruses, or other dangerous for the community software, or all of the named, compatible with the GSRV software or hardware, is rigorously prohibited.

  7. The utilisation of GSRV products, software or service(s) for running or supporting fraud, fraudulent activities, production of viruses, cyber-attacks, promoting illegal content, substances or unlawful activities and campaigns, or participating in any of the following, whether as an accomplice or not, is stringently forbidden. If GSRV suspects that you are involved in one or more of the listed above acts, we might perform a private investigation with or without informing you, suspend your account or report you to local, national and international authorities, regardless of your nationality or citizenship. If you fall victim or are a witness of such operations, please immediately contact support@gsrvhosting.com and provide us with the information you hold.

  8. The use of an automated script, bot, robot or otherwise if you are sending more requests to our servers than a user with a regular browser and operating system is prohibited and might result in a permanent or temporary account suspension. The currently agreed-upon standard is 30 requests per minute.

  9. Damaging GSRV property, whether digital (in the form of software, for instance), material and intellectual, is not corresponding to the GSRV Terms of Use and might result in further legal challenges.

  10. All content you submit, upload, or otherwise make available through the use of the Services (“Content”) might be reviewed by GSRV or be sent to third-party verification services (including, but not limited to, spam prevention services). Do not submit any Content that you consider to be private or confidential.

  11. We reserve our right to remove or modify any Content submitted at any time, with or without cause or notice. We undertake requests for Content to be removed or modified at our discretion only. We might terminate your access to all or any part of the Services at any time.

  12. You are granting us with a non-exclusive, permanent, irrevocable, unlimited licence to use, publish, or re-publish your Content in connection with the Services. You retain copyright over the Content.

  13. We are not responsible for any user-generated content and accounts. The submitted Content expresses the views of their author only.

  14. All billing and registration information provided by you to GSRV must be truthful and accurate. Providing any untruthful or inaccurate information constitutes a breach of these Terms.

  15. You might not register an account on behalf of entities or other beings, different from yourself, without their agreement.

  16. When registering for a GSRV account, you may not use a disposable or a temporary e-mail address, commonly unofficially referred to as “DEA” (Disposable Email Addressing), “temp[orary] [e]mail” or “dark [e]mail”. We might suspend accounts with such e-mail addresses without notice. If you find yourself in violation of this section, you might change your e-mail address to comply with the Terms, hence avoid being suspended.

  17. By agreeing to the Terms, you also accept the GSRV Privacy Policy. Please make sure to read our Privacy Policy afore submitting your acceptance of the Terms.

  18. The Terms may be downloaded and printed for your reference. The published Terms of Use on our website are always the latest version.

  19. The original and actual version of the Terms is in English. If you are reading a translation, the English version shall always take precedence.

  20. The user is solely responsible for the confidentiality and preservation of their log-in and authentication credentials, as well as their usage within the Services.

  21. You concur to receive information, announcements and other communications from GSRV electronically, such as email, mobile push notifications, or notices within the Services. For any direct marketing messages, we will ensure that we obtain your consent prior to the distribution of such materials to you.

  22. By utilising the Services or providing information to GSRV, you concur that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your usage of the Services, and that all agreements, notifications, disclosures, and other communications that we provide satisfy any legal requirements that such correspondences be in writing.

  23. If you choose to provide feedback, comments or suggestions for improvements to the Services or otherwise (in written or oral form) (“Feedback”), you represent and warrant that:

    • you have the right to disclose the Feedback;
    • the Feedback does not violate the rights of any other person or entity;
    • your Feedback does not contain the confidential or proprietary information of any third party or parties.

  24. By sending us any Feedback, you further

    • agree that we are under no obligation of confidentiality, express or implied, with respect to the Feedback,
    • acknowledge that we may have something similar to the Feedback already under consideration or in development,
    • grant us an irrevocable, non-exclusive, royalty-free, perpetual, worldwide license to use, modify, prepare derivative works from, publish, distribute and sublicense the Feedback, and
    • irrevocably waive, and cause to be waived, against GSRV and its users any claims and assertions of any moral rights contained in such Feedback. This section and the one above shall survive any termination of your account or the Services,
    • concur that all rights in this section and the one above are granted without the need for additional compensation of any sort to you

  25. We use third-party services to help us provide the Services, but such use does not indicate that we endorse them or are responsible or liable for their actions. In addition, the Service may link to third-party websites to facilitate its provision of services to you. If you use these links, you will leave the Service. Please note that your use of such third-party services will be governed by the terms and privacy policy applicable to the corresponding third party. Some of these third-party websites may use Service Materials under license from us. We are not responsible for nor do we endorse these third-party websites or the organisations sponsoring such third-party websites or their products or services, whether or not we are affiliated with such third-party websites. You agree that we are not responsible or liable for any loss or damage of any sort incurred as a result of any such dealings you may have on or through a third-party website or as a result of the presence of any third-party advertising on the Services.

  26. You may terminate your account at any time and for any reason by deleting your account by contacting us in writing. GSRV may terminate your account and your access to the Service (or, at our sole option, applicable portions of the Services) at any time and for any reason. We are not required to provide you with any notice or warning prior to any such termination. You may, as the result of the termination, lose your account and all information and data associated therewith, including without limitation your Account Funds and other virtual goods, as applicable, and GSRV is under no obligation to compensate you for any such loss.

  27. THE SERVICES AND THE SERVICE MATERIALS ARE PROVIDED "AS IS" AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. IN ADDITION, WHILE THE COMPANY ATTEMPTS TO PROVIDE A GOOD USER EXPERIENCE, WE CANNOT AND DO NOT REPRESENT OR WARRANT THAT THE SERVICES WILL ALWAYS BE SECURE OR ERROR-FREE OR THAT THE SERVICES WILL ALWAYS FUNCTION WITHOUT DELAYS, DISRUPTIONS, OR IMPERFECTIONS. THE FOREGOING DISCLAIMERS SHALL APPLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

  28. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY, BE LIABLE TO YOU OR TO ANY THIRD PERSON FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR OTHER INDIRECT DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICE OR OTHER MATERIALS ON, ACCESSED THROUGH OR DOWNLOADED FROM THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF THESE DAMAGES.THE COMPANY SHALL NOT BE LIABLE TO YOU FOR MORE THAN THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN ACCORDANCE WITH THESE TERMS IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT A CLAIM OR (B) $100. THE LIMITATIONS AND DISCLAIMERS IN THESE TERMS DO NOT PURPORT TO LIMIT LIABILITY OR ALTER RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHICH MEANS THAT SOME OF THE ABOVE DISCLAIMERS AND LIMITATIONS MAY NOT APPLY TO YOU. IN THESE JURISDICTIONS, DISCORD’S LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

    • You specifically acknowledge that GSRV shall not be liable for user content, or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

Terms of Sale

  1. When adding or depositing funds to your GSRV account, you consent that you are the legitimate holder of the credit/debit card, bank account or owner of the PayPal account, where applicable.
  2. By placing an order, you authorise GSRV or the accredited merchant to charge you the stated price of the purchase.
  3. GSRV reserves the rights to modify the price or benefits of any package. These changes apply to you at the beginning of your next billing cycle. If you do not agree to these changes, cancel your services or contact us at payments@gsrvhosting.com for assistance. We will notify you by e-mail prior to making any changes that might affect your billing.
  4. GSRV guarantees the performance that we promise in our promotions, advertisings, announcements and websites. You can request to have back the money that you have paid for all plans within 30 days after the registration date of your GSRV account without having to provide any reason or basis for the fulfilment of this request. Please note that fees from your bank may apply to this refund. After you request your money back, GSRV will cancel your servers and suspend your account instantaneously or spontaneously.
  5. If another client purchases on GSRV after having registered with your affiliate link, you will receive the agreed-upon percentage of their payment as a deposit to your GSRV account balance.
  6. If the client that is referred by you to us via our affiliate program has opened their account within 30 days, you will receive your affiliate bonus after that period, unless they request to receive their money back. In this case, you will not receive the affiliate reward.
  7. If the client that is referred by you to us via our affiliate program opens a chargeback against any payment to GSRV, we will put your affiliate reward for that payment on hold, and you will not be able to use it during the dispute. You will only receive the account funds again if the chargeback results in favour of GSRV.

Returns and Refunds

  1. GSRV issues no refunds for digital services and products, such as but not limited to, hosting services, software, domains, except as described in sections 4 and 5 from our Terms of Sale.
  2. We issue no refunds for account balance deposits. You can withdraw Account Funds, subject to article Terms of Sale, paragraph 4.
